1. GENERAL TERMS

The buyer’s acceptance of any offer for the supply of goods or services includes the acceptance of these conditions of sale which can only be varied expressly and by mutual agreement in writing, signed by or on behalf of Galleries by Xtreme Arts (hereinafter called “the Company”).

 2. ACCEPTANCE AND PAYMENT

Orders will be process on receipt of full payment for goods. The Company will retain all goods until full payment for such goods has been received. Payment can be made by credit/debit cards, cheque or direct bank transfer. On receipt of a written order for customised imagery, the Company will prepare and present a proof for approval by the buyer unless otherwise agreed or varied in writing. In the event of non payment of any order, work will be suspended immediately until payment has been received. All prices quoted are inclusive of VAT where applicable at the rate ruling at the time. The Company reserve the right to change prices without prior notice.

3. GOODS SATISFACTION

All measurements stated are approximate. Dimensions given relate to frame sizes. Colours may vary slightly from proofs. The buyer must allow for screen variation when ordering online. The Company guarantees that it will perform the contracted services with reasonable care and skill and that goods and services supplied under this agreement shall be fit for purpose and will comply with the buyer’s specification as far as is reasonably possible. Returns will be accepted within 14 days of delivery providing the goods are returned to the Company in re-saleable condition.
 
4. LIABILITY

The Company will not be liable to the buyer for any loss, damage, cost, expenses, consequential loss or other claims for compensation arising out of the provision or non provision of goods or services to the buyer from the Company.The liability of the Company under this agreement will not exceed the sum payable by the buyer. This does not effect your statutory rights.

5. COPYRIGHT

Any design created by the Company remains the copyright of the Company and may not be personally/commercially reproduced or resold unless by prior agreement with the Company. Any attempt to plagiarise any design created by the Company will be pursued vigorously. All copyright to photographs and the images contained therein are the exclusive property of the Company who may choose to use them for commercial purposes and without the express permission of the buyer.

6. DELIVERIES

Deliveries are by courier to UK mainland addresses. A standard charge of £8.95 packaging and delivery applies to all orders. Normal delivery hours are weekdays 9am-5pm and a signature is required upon receipt. Deliveries outside the UK can be arranged but are not covered by our standard charge for packaging and delivery. The buyer must allow 21 days for delivery. The Company will not accept responsibility for meeting deadlines set by the buyer due to other reasons which are beyond their control.

7. GOVERNING LAW

These terms and conditions shall in all respects be construed and operated under English Law and all matters arising thereunder shall be determined in accordance with the laws of England.
